Seminar on 'The Estate Administration Process: Challenges, Opportunities and Best Practices'

ILS Law College is happy to announce organisation of a seminar on

‘The Estate Administration Process: Challenges, Opportunities and Best Practices’

on Saturday, 15th March 2025

Background:

The Seminar is about probate, letters of administration, succession certificates and heirship certificates, the procedures for obtaining these, and the effects of these certificates.

Beneficiaries of a deceased’s estate like to administer the estate quickly and economically. While they are entitled by law to manage and deal with the estate without formal recognition given by any court, persons holding the deceased’s estate may not be willing to hand it over to them, or to recognise them unless they are assured of a discharge.

Administration involves the task of collecting the properties, paying off debts and distributing the estate among the persons entitled. Persons owing debts or holding properties of the deceased take a risk if they pay off to any heir making a claim, because they are liable to all heirs if the deceased has died intestate, or to the persons to whom the deceased has given properties under his final and valid will. They desire discharge and indemnity. The law gives it to them if the representatives hold certificates issued by courts. Certificates are also required by law in some circumstances.

This administration process touches upon the life of each of us; and for this purpose, effective and mature and accurate legal advice is indispensable.

The Seminar will deliberate on various important aspects of proceedings for grant of certificates.

Key Themes:

  1. The necessity of taking representation.
  2. Procedures for all administration proceedings (Contentious and Non-Contentious).
  3. The certificate and its legal effect.
  4. Revocation proceedings.
  5. Keynote address by Hon’ble Mr Justice Abhay Oka, Judge, Supreme Court of India.
